BANKRUPTCY

Introduction

Many people ask us to help them go bankrupt.

Going bankrupt is a very serious step to take.

As an advice agency it is our job to make sure that you fully understand the procedure, and particularly how bankruptcy may affect you and your family, now and in the future.

Therefore we will not help anyone to fill in bankruptcy forms unless they have gone through the procedure which we have agreed in the bureau, based on the extensive knowledge and experience we have gained over the years.

Bankruptcy Advice Procedure

If you ask for advice about going bankrupt at Rushmoor CAB, we will use the following procedure:

  1. We will ask you to provide details of all your debts, income and expenses.

  2. We will help you to check if you are responsible for all these debts and look at ways in which you could increase your income.

  3. We will ask you to work with us to prepare a Personal Budget to show your full financial situation.

  4. When you have a Personal Budget we can help you look at the different ways of dealing with your debts.

  5. If you decide that bankruptcy is the best way for you to deal with your debt, and you would like more information about the process, we will ask you to go through our Bankruptcy Checklist - we may ask you to make an appointment for this.

  6. The checklist is to make sure that you understand how bankruptcy will affect you, your work, your home and other aspects of your life.   When the checklist is complete we will ask you to sign it to confirm the advice you have received.

  7. If you decide that you want to go ahead with the bankruptcy we can give you our Bankruptcy Pack which gives more information about the process and the court application.

  8. If bankruptcy is an appropriate option for you, we can help you fill in the Court papers.   However we can only do this when you supply the information needed to complete the form.

This process is obviously complex, and may take several visits.

As we have limited resources we can only offer to help at Court and with the Official Receivers interview to a very few clients.

Please note that bankruptcy is not automatic – it is the Court that ultimately decides whether or not you are bankrupt.

If you do not wish to follow the procedure outlined in this leaflet, you may, of course, go bankrupt without assistance from CAB.   Help is available on www.insolvency.gov.uk
